nadicode Acceptable Use Policy

1. Scope

1.1. This Acceptable Use Policy ("Policy") applies to all use of Nadia, Alveare, and portal.nadicode.ai (together, the "Service") by Customer and its authorized users.

1.2. This Policy is incorporated by reference into the nadicode Terms of Service. Capitalized terms not defined in this Policy have the meaning given to them in the Terms of Service.

2. Prohibited Uses

Customer shall not use, and shall not permit any Agent or authorized user to use, the Service to:

2.1. Engage in, facilitate, or promote any illegal activity under applicable law.

2.2. Create, store, transmit, or generate content that is infringing, defamatory, or otherwise unlawful.

2.3. Develop, distribute, or facilitate malware or the development of weapons of any kind.

2.4. Harass, threaten, or abuse any person.

2.5. Deceive or impersonate a human being without disclosing that the interaction involves an AI system, consistent with the AI-interaction disclosure described in the Terms of Service.

2.6. Make fully automated decisions that produce legal effects concerning a natural person, or similarly significantly affect a natural person, without human oversight.

2.7. Provide medical, legal, or financial advice to a natural person without qualified human review before the advice is relied upon or communicated.

2.8. Circumvent, disable, or attempt to circumvent or disable any usage limit, rate limit, or safety control of the Service.

2.9. Send unsolicited bulk messages, or messages that break the rules of the channel or service they are sent through, including through an Agent.

2.10. Use an App Connection to an account the Customer is not entitled to use, or in breach of the terms of the service it connects to.

2.11. Remove, hide or alter the disclosure that an Agent is an AI system, or the marking of content an Agent generated.

2.12. Use the Service for a purpose excluded by clause 9.4 of the Terms of Service, including the high-risk purposes listed in Annex III of the EU AI Act.

2.13. Conduct red-teaming, penetration testing, or other security testing of the Service without nadicode's prior written authorization.

3. Upstream Model Provider Policies

3.1. Agents route inference requests through OpenRouter to Upstream Model Providers. Customer's use of the Service must also comply with the usage policies of each Upstream Model Provider whose models Customer's Agents access.

3.2. nadicode may relay Upstream Model Provider restrictions to Customer and may enforce those restrictions against Customer's use of the Service.

3.3. Customer shall not access, or attempt to access, a model restricted by an Upstream Model Provider in circumvention of that provider's terms.

4. Enforcement

4.1. A violation of this Policy may result in a warning, suspension, or termination of Customer's access to the Service, applied proportionately to the nature and severity of the violation, in accordance with clause 20 of the Terms of Service.

4.2. nadicode may investigate suspected violations of this Policy and may take interim action, including temporary suspension, where reasonably necessary to prevent harm while an investigation is ongoing.
